Promil® Win Gifted Rewards 2025
A. TERMS AND CONDITIONS
1. The Promoter of Promil® Gifted Rewards 2025 (the "Promotion") is WYETH PHILIPPINES INC of Makati Administrative Office, 3/F MAKATI ADMINISTRATIVE OFFICE, 31 PLAZA DRIVE, ROCKWELL CENTER, MAKATI CITY, referred to herein as ‘Promil®’ ("Promoter").
2. The Promotion is administered by TLC Marketing Worldwide (Singapore) Pte Ltd, a company duly existing under the laws of Singapore (UEN: 201923399W) 1 Harbour Front Ave, Keppel Bay Tower, #05-02 Singapore 098632, referred to herein as the (“Administrator”). All correspondence regarding this Promotion should be directed to this address or through the Promotional Helpline as outlined in Section F, item 11.
3. Instructions on how to enter and mechanics of prize redemption form part of these Terms and Conditions.
4. Participation in this Promotion shall be deemed as acceptance of these Terms and Conditions.
5. The decisions of the Promoter for all matters relating to the Promotion shall be final and binding in all respects.
B. CONDITIONS OF ENTRY
An Entrant must meet all of the following conditions of entry (“Entrant”):
1. This Promotion is only open to Philippine residents aged 18 years and over at the time of entry, who remain Philippine Residents for the duration of the Promotional Period.
2. As a condition of entering this Promotion, an Entrant consents to the Promoter and/or the Administrator using the Entrant’s name, locality and other relevant personal information in any media in the Philippines for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the Promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter or the Administrator. To this end, Entrant knowingly and voluntarily allows the Promoter and its authorized third parties to collect, store, and process copies of his/her personal information, in accordance with its Privacy Policy, which can be accessed through https://www.nestle.com.ph/info/privacypolicy. Except as otherwise stated, any personal information obtained relative to the authority herein given shall be strictly confidential.
C. KEY DATES
The Promotional and Redemption Period begins on 12.00am (Philippine time) on June 2, 2025, and ends at 11.59pm (Philippine time) on October 31, 2025. (“Redemption Period”). Redemption Period is defined as the period when the Entrant can submit their Unique Code and Proof/s of Purchase on the campaign website and claim their reward voucher. No submissions of Unique Code or redemption of reward vouchers shall be allowed beyond this period.
D. HOW TO ENTER
1. During the Promotion Period, visit any participating outlet nationwide (supermarkets, hypermarkets, groceries, drug stores, wholesaler stores, ecommerce stores) in the Philippines and purchase any of the specially marked Promil® promo products. (“Qualifying Purchase”). Also, Wyeth milk products which are covered by the Philippine Milk Code shall be expressly excluded from this Promotion.
2. For the purposes of this promotion, the Participating Products (“Participating Products”) are as follows:
a. PROMIL ® POWDERED MILK DRINK FOR CHILDREN ABOVE 3 YEARS OLD (3+) 2.4kg
b. PROMIL GOLD ® POWDERED MILK DRINK FOR CHILDREN ABOVE 3 YEARS OLD (3+) 2.4kg
3. Upon making a Qualifying Purchase, during the Redemption Period, Entrants should retrieve the promotional website address and Unique Participation Code found inside the packaging of the Participating Promil® products.
4. Entrants should visit the Promotional Website by scanning the QR code or entering the address on their browser https://www.wingiftedrewards.com (“Promotional Website”), where they will need to fill in the Participation Form (“Participation Form”) by entering the following information:
a. Unique Code
b. First Name
c. Last Name
d. Email Address / Email Confirmation
e. Mobile Number
f. Upload Official Receipt (“Proof of Purchase”)
g. Confirm 18 years or older.
h. Agree to the Terms and Conditions and Privacy Policy of the Promotion
i. Agree to TLC Opt In (Optional)
5. Upon successful submission of the entry, Entrants will immediately receive a confirmation of their entry submission via email (“Participation Confirmation Email”).
6. Multiple entries are permitted, subject to the following:
a. One (1) Unique Participation Code per entry is permitted found in the pack.
b. Each Unique Participation Code and Proof of Purchase must be submitted separately and in accordance with entry requirements of these Terms and Conditions.
7. Total number of specially marked promotional packs to be produced is 62,000 units.
E. HOW TO CLAIM INSTANT REWARDS
1. Upon successful validation of the entry, during the Redemption Period, Entrants will receive an email from contact@wingiftedrewards.com confirming their successful entry to the promotion, a Unique Claim Link, and details on how to claim their reward (“Successful Entry Email”).
2. To choose a reward, Entrants must click on the Unique Claim Link found on the Successful Entry Email which will lead them to the rewards listing page on the Promotional Website.
3. The rewards available for Entrants to choose from will depend on their Qualifying Purchase:
a. Buyers of the PROMIL ® POWDERED MILK DRINK FOR CHILDREN ABOVE 3 YEARS OLD (3+) 2.4kg can choose one (1) reward with from a pool of rewards from the Administrator’s Activities and Learning Network with a value of up to P1,000.00. A full list of rewards are outlined in Schedule 1.
b. Buyers of the PROMIL GOLD ® POWDERED MILK DRINK FOR CHILDREN ABOVE 3 YEARS OLD (3+) 2.4kg can choose one (1) reward with from a pool of rewards from the Administrator’s Activities and Learning Network with a value of up to P1,500.00. A full list of rewards are outlined in Schedule 1.
4. Entrants can view the available rewards and select their preferred reward.
5. Upon successfully submitting their claim, Entrants will receive an email containing their chosen reward details and reward voucher. (“Claim Confirmation Email”)
6. Claims will be deemed to be received only when acknowledged by the Administrator. The Promoter and Administrator are not liable for any problems with communication networks including but not limited to email blockage, incoming call rejections. If an Entrant enters using automatically generated entries or multiple phone numbers/email addresses/addresses/aliases, they may be disqualified.
F. OTHER GENERAL TERMS AND CONDITIONS
1. Entrants will be required to keep the physical receipt as Proof of Purchase, or a photo of the physical receipt as Proof of Purchase where in the case of an issue, Administrator will require it for verification purposes. Failure to provide the receipts and/or Proof of Purchase may be a ground for disqualification from redeeming the reward.
2. Participating Products may not always be available for sale in all participating outlets during the Promotion Period. The Promoter accepts no responsibility for any participating products being unavailable at the participating outlets during the Promotion Period.
3. Rewards are subject to availability and are not exchangeable or redeemable for cash. If a reward is unavailable, for whatever reason, the Promoter or Administrator reserves the right to substitute the reward for a reward of equal value and/or specification, subject to any written approval from the relevant regulatory authorities.
4. Without limiting any other terms of these Terms and Conditions, all prizes (and elements of prizes) must be taken as and when specified, or will be forfeited with no replacement. The reward values are correct as of the date of preparing these Terms and Conditions and include any applicable VAT. The Promoter and Administrator are not responsible for any change in reward value.
5. In the event the Promotion is unable to proceed as set out in these Terms and Conditions, the Promoter and Administrator reserve the right to vary these Terms and Conditions, subject to any written approval from the relevant regulatory authorities.
6. The Administrator is not responsible for any tax implications arising from an Entrant winning a prize. Entrants should seek independent financial advice.
7. The Promotional Website may contain links to other websites (“Linked Sites”), including websites of Promotional Partners (“Promotional Partner Websites”). The Promoter is not responsible for the content of any Linked Sites, whether or not the Administrator are affiliated with the Linked Sites. The Administrator does not in any way endorse any Linked Sites and is not responsible for the quality or delivery of any products or services offered, accessed or advertised by such Linked Sites. To the extent that these Linked Sites collect personal information or postings from Entrants, the Administrator shall bear no responsibility or liability for the manner in which such information or postings are used or exploited. The Linked Sites are for Entrants’ convenience only, and Entrants agree to access them at their own risk.
8. The Promoter is not liable for entries, reward claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted.
9. Any additional or ancillary costs associated with redeeming a reward are not included. Those costs are the responsibility of the Entrant who redeems the reward. Costs associated with redeeming the reward may include, but are not limited to, the Entrant’s transport to and from a participating merchant. Accessing any Promotional Partner Website and downloading, using or installing any Application is the Entrant’s responsibility and at the Entrant’s risk and steps required may vary depending on the internet service or telecommunications provider used.
10. No compensation will be payable to any person if a winner is unable to submit a reward claim in the time and manner set out in these Terms and Conditions for whatever reason.
11. HELPLINE: For enquiries regarding Promil® Gifted Rewards promotion, consumers may call the Promotional Helpline on 1800 1550 0027 between the hours of 9:30am and 5:00pm or email contact@wingiftedrewards.com during the Promotional Period, Monday to Friday, excluding Public Holidays.
12. This Promotion is in no way sponsored, endorsed or administered by, or associated with any social media platform, including Facebook, Instagram and Twitter. Entrants provide information to the Promoter and not to any social media platform. Entrants completely release any relevant social media platforms from any and all liability.
13. Authorised under: Per DOH-FDA-CFRR Permit No. 0068 s. 2025.
G. LIABILITY & RESPONSIBILITY
1. In the event that the Promotion is not capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, dishonesty, technical failures, or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right to disqualify any individual who tampers with the entry process or does not comply with these Terms & Conditions and to cancel, modify or suspend the Promotion or invalidate any affected entries.
2. No responsibility can be taken for entries which are lost, delayed, corrupted, damaged, misdirected or incomplete or which cannot be delivered for any technical, delivery or other reason. Proof of sending will not be accepted as proof of receipt. The Promoter does not guarantee continuous or secure access to the Promotional Website.
3. Promoter together with any associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion or accepting or using a Prize, except for any liability which cannot be excluded by law.
4. An entry must be made directly by the individual entering the Promotion via their unique email address. Bulk entries from trade, consumer groups or third parties will not be accepted. Incomplete or illegible entries and entries submitted by macros or other automated means together with entries which do not satisfy the requirements of these Terms & Conditions in full will be disqualified and will not be counted. If it becomes apparent that an participant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that participant’s entries into the Promotion in a way that is not consistent with the rules of the Promotion, that participant’s entries will be disqualified and any reward awarded will be withdrawn.
5. The Promoter will not be liable for any failure to comply with its obligations or any delay in performing its obligations within these terms and conditions. If an act, omission, event or circumstance occurs caused by (but not limited to) global or regional health crises, weather conditions, fire, flood, strike, hurricane, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, epidemic, pandemic, famine, plague or other natural calamities and acts of God, or any other circumstances beyond the reasonable control of the Promoter.
6. The Promoter may refuse to allocate a reward in the event of any participant’s fraud, dishonesty, breach or non-entitlement under these Terms & Conditions or seek recovery of its value if a Reward has been awarded.
7. Any and all personal data provided by you in connection with this Promotion will be used solely by the Promoter (or its appointed agents) to: (i) assist with running the Promotion; and/or (ii) conduct analytics to improve the Promoter’s promotions, products or services. The Promoter (or its appointed agents) will not contact you for reasons other than this Promotion unless you have provided your express consent. All personal data will be handled in accordance with the Promoter’s privacy policies.
8. If any provisions of these Terms & Conditions are judged to be invalid, illegal or unenforceable, this will not affect or impact the continuation in full force and effect the remainder of the provisions.
9. By entering this Promotion, you will be deemed to have agreed to be bound by these Terms & Conditions. In the event of a discrepancy between these Terms & Conditions and the details in any promotional material, the details in the Terms & Conditions will prevail.
10. By entering the Promotion, each participant agrees:
a. to be bound by these Terms & Conditions and by all applicable laws and by the decisions of Promoter which shall be binding and final;
b. to waive any rights to claim ambiguity with respect to these Terms & Conditions
c. to waive all his or her rights to bring any claim, action or proceeding against any of the Released Parties in connection with the Promo; and
d. That all personal details submitted by each user must be accurate, complete and are subject to provision of proof upon request of the Promoter. Any inaccurate or incomplete information found in a submission will result in disqualification of the user
e. That the Promoter has the sole discretion to disqualify any photograph or screenshot which may be obscene, profane, lewd, defamatory, threatening, harassing, libelous, deceptive, invasive of another’s privacy, offensive or inappropriate in any manner whatsoever
f. That the Promoter reserve the right to change/modify terms and conditions and/or criteria of the Promotion and/or the reward for the Promotion and/or the duration/timing of the Promo, at any time at their own discretion and without any prior notice and without assigning any reason
g. To grant the Promoter irrevocable consent in perpetuity to the use his/her and/or person’s involved name, photographs, video submitted and/or taken during the reward distribution in connection with the Promo, in any and all applications including but not limited to advertising, commercials, promotion, stories, text, articles and commercial exploitation, in any and all media forms, including but not limited to radio, broadcast and television, newspapers and magazines at any time without the Entrant’s further knowledge or consent
h. Promoter shall not be responsible for any complaints regarding the quality of the prize. The manufacturer shall continue to be liable for the prizes, wherever applicable.
i. To forever and irrevocably agree to release, defend, indemnify and hold harmless each of the Released Parties from any and all claims, lawsuits, judgments, causes of action, proceedings, demands, fines, penalties, liability, costs and expenses (including, without limitation, reasonable outside attorneys’ fees) that may arise in connection with:
j. the violation of any third-party privacy, personal, publicity or proprietary rights;
k. typographical or printing errors in these Official Rules or any Promotional materials;
l. acceptance, attendance at, receipt, travel related to, participation in, delivery of, possession, defects in, use, non-use, misuse, inability to use, loss, damage, destruction, negligence or wilful misconduct in connection with the use of a reward (or any component thereof);
m. any change in the prizing (or any components thereof) due to unavailability or due to reasons beyond the Released Parties control, including but not limited to by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi- governmental entity (whether or not such action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, threatened or actual terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labour dispute or strike (whether legal or illegal), labour or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot or any other cause beyond any of the Released Parties’ control, or as otherwise permitted in these Terms & Conditions Rules;
n. any interruptions in or postponement, cancellation or modification of the Promotion;
o. human error;
p. incorrect or inaccurate transcription, receipt or transmission of any part of any entry (including, without limitation, the registration information or any parts thereof);
q. any technical malfunctions or unavailability of the Page or any telephone network, computer system, computer online system, mobile device, computer timing and/or dating mechanism, computer equipment, software, or Internet service provider, or mail service utilized by any of the Released Parties or by an Participant;
r. interruption or inability to access the Promotion, the Page or any other Promo-related websites or any online service via the Internet due to hardware or software compatibility problems;
s. any damage to participant’s (or any third person’s) equipment used to access the Promotion and/or its contents related to or resulting from any part of the Promotion;
t. any lost/delayed data transmissions, omissions, interruptions, defects, and/or any other errors or malfunctions;
u. any late, lost, stolen, mutilated, misdirected, delayed, garbled, corrupted, destroyed, incomplete, undeliverable, or damaged entries;
v. any wrongful, negligent, or unauthorized act or omission on the part of any of the Released Parties;
w. lost, late, stolen, misdirected, damaged, or destroyed prizing (or any element thereof);
x. the negligence or wilful misconduct by Participant; and/or
y. violation on any rule, regulation, law regarding Covid-19 prevention and safety.
11. Warranty: Without limiting the foregoing, everything regarding this Promotion, including the Page and/or all reward component(s), are provided “as is” without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a purpose or non-infringement.
12. DISPUTES: Except where prohibited, Entrants agree that: a) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any reward awarded shall be resolved individually, without resort to any form of class action; b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promo, but in no event attorneys’ fees; and c) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Entrants agree that the statute of limitations for asserting any claims shall be a period of one (1) year from the time the cause of action accrued, or the cause of action shall be forever barred.
13. PRIVACY POLICY: Any personally identifiable information collected during the Promotion will be collected by the Promoter or its designee and used by Promoter’s, its affiliates, designees, agents and marketers for purposes of the proper administration and fulfilment of Promotion as described in these Terms & Conditions and in accordance with the Privacy Policy of the campaign and Wyeth’s Privacy Policy, accessible at https://www.nestle.com.ph/info/privacypolicy.
14. WINNER WAIVER OF CLAIMS: By accepting a Promotion Prize, a winner agrees to voluntarily waive, release and relinquish any and all claims, damages, losses, expenses, remedies, demands, debts, obligations, causes of action and/or claims for relief (collectively “Claims”) that a winner may have against the Released Parties and agrees to discharge, to indemnify and hold harmless the Released Parties from all Claims arising out of or relating to the Promotion and/or a Promotion Prizes, including but not limited to Claims for bodily injury, personal injury, emotional distress, property damage, or death and/or dismemberment (collectively “Damages”) occurring to a winner or others. In addition, by accepting a Prize, a winner agrees to be responsible to research the details about a reward including any inherent dangers associated with a reward and as a result agrees to accept personal responsibility for any such dangers and any resulting Damages.
CAUTION AND WARNING: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE, THE PAGE, OR TO UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
INSTANT WIN REWARD GENERAL
1. The value of each Instant Reward is in accordance with the table above. Each prize is valued in Philippine Peso inclusive of VAT (if any) based on the recommended retail value as of the time of permit application. The Promoter or Administrator takes no responsibility for any variations in the value of a prize.
2. The maximum number of Instant Rewards given away for this promotion is 62,000. The final number of prizes distributed by the Promoter or Administrator will be the number of prizes redeemed by the Entrants.
3. If a winner fails to redeem a prize in the manner required, as stated in these Terms and Conditions and in the reasonable opinion of the Promoter or the Administrator, the prize will be forfeited with no compensation payable.
4. The Promoter (including its directors, officers, employees and agents) and the Administrator reserve the right, at any time, to verify the validity of claims and the Entrant (including the Entrant’s identity, age and place of residence) and reserve the right, in their discretion, to disqualify any individual who they have reason to believe has breached any of these Terms and Conditions, tampered with the claim process or engaged in any unlawful or other improper conduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter’s and the Administrator’s discretion. The Promoter's and the Administrator’s legal rights to recover damages or other compensation in such circumstances are reserved.
5. If a reward (or part of a reward) becomes unavailable, for any reason beyond the Promotional Partner or Promoter’s reasonable control (as applicable), then a comparable prize (or part of a reward) of equal or greater value will be awarded in lieu, at the Promotional Partner or Promoter’s discretion, subject to any written approval of the relevant regulatory authorities.
6. All Promotion advertisements depicting prizes, prize descriptions and/or trademark references are illustrative rather than definitive and do not imply any association with the Promoter.
7. It is the responsibility of the winning Entrant to use their reward by any specified expiry date. The reward is issued with the understanding that they will not be extended or replaced. Any unused balance of the reward will not be awarded as cash. Redemption of the reward is subject to any Terms and Conditions of the issuer.
8. Timeframes for delivery indicated in these Terms and Conditions may be affected by circumstances outside of the control of the Administrator and the Promoter, including, but not limited to strikes, fires, floods, earthquakes, other natural disasters, epidemic, pandemic, government directive, public health orders acts of terrorism, blackouts and the like. The Administrator and the Promoter will not be liable for delays caused by circumstances outside of its control.
